Felony Assault Charges require knowledgeable professional representation in order to preserve the rights that you have, and to effectively fight back against your accuser. You should never speak to the District Attorney or any investigator, including the police, because anything that you say will be used against you.
The number one mistake that accused people make is to try to convince the police or the District Attorney that they are innocent. The DA and the police use these statements against the accused every time. Often, their statements are twisted and misconstrued into admissions of guilt. Only an experienced attorney should discuss your case with the DA or the police, and often these discussions lead to a reduction or dismissal of the charges.
Penalties for assault can range from six months in county jail to many years in the Department of Corrections. Additionally, some crimes carry mandatory sentences to the State Department of Corrections. The sentencing schemes that the Colorado Legislature enacted are complex, and the District Attorney will always “overcharge” Defendants, because they anticipate the possibility of a plea bargain. However, the District Attorney will only give you a “bargain” if you have an attorney who knows how to force it out of them. If you try to go it alone, you will not get a reasonable plea bargain.

  • Winston H was charged with assaulting his girlfriend after himself being the victim of his girlfriend's attacks.
